Reasons

The landlord attended the hearing by remote teleconference. Attempts were made to contact the tenant on both telephone numbers provided with the application. Both attempts were unsuccessful. The hearing proceeded in the absence of the tenant.

The landlord has applied for termination of the tenancy for abandonment and rent arrears.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 4 March 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

The landlord says that they became concerned when the tenant missed her rent payment on 31 January 2024. A letter was sent on 14 February 2024 in respect of rent payments. A further letter regarding rent arrears was sent on 27 February 2024.

On 4 March the landlord contacted the tenant’s sister who confirmed that the tenant had moved to Australia.

The landlord issued a 14 day ‘return to property’ notice to the tenant on 12 March 2024. The tenant has not remedied the breach.

The landlord received written notification from integrity services on 10 April 2024 confirming the tenant had departed New Zealand on 14 December 2023 and has failed to return.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
