The landlord attended the hearing which was held by teleconference. The tenant did not attend. The tenant was contacted twice on the contact number provided in the application but without success. I proceeded with the hearing in the tenant’s absence as I was satisfied adequate service of the hearing notice had been completed.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. On 15 April 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. This was the date the landlord carried out an inspection of the premises and photographs show no sign of someone living at the property - there was no furniture except a cot, an empty suitcase, speaker and a mattress in the backyard. The inspection report notes the power had been cut off.
Multiple attempts by the landlord to contact the tenant since have been unsuccessful.
As the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
