Both parties attended the hearing. The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.

Should the tenancy be terminated?

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
Ms Selwyn submitted that she had a valid cross application to make because of problems with the plumbing at the house. The parties both acknowledged that there has been an MBIE investigation into the plumbing issues.
If tenants want their grievances to be taken into consideration in a Tribunal hearing they need to file an application before the hearing takes place. This is so the adjudicator can consider if there is any merit to the cross application. Sometimes the landlord’s application for termination is put off and the two applications are heard at the same time. Sometimes the tenancy is terminated.
Ms Selwyn did not file her cross application by the time we had the hearing. Because of the investigation I allowed 24 hours after the hearing for Ms Selwyn to provide supporting evidence from the investigations team that there were ongoing concerns. We did not receive any information from Ms Selwyn.
I find the landlord’s application for termination should be finalised. Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount of rent owed was agreed at the hearing.
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee.
The landlord’s application for suppression is allowed because the landlord is the most successful party.
