Mr Hosseinpour gave evidence that he and his wife did not have time to finish the cleaning as they were very busy moving and had 18-month-old twins. He said they did as much as they could.
Mr Hosseinpour challenged the amount charged for cleaning. He calculated that the tasks required would have taken 73 minutes.
I have considered the tenant’s submission. However, the evidence produced by the landlord (photos and an invoice) establish that the costs claimed were reasonable.
The invoice is based on the time actually incurred, not on an estimate of what the tenant considers the time would be.
When a tenant does not comply with their statutory responsibilities, a landlord is entitled to have the work done.
The Tribunal cannot decline or reduce the landlord’s claim given Mr Hosseinpour’s acceptance that cleaning work was required and the invoice and photographic evidence produced by the landlord.
The remaining bond, which equates to the amount claimed for cleaning, will be paid to the landlord.
The parties reached an agreement on other matters in dispute, and they are not part of the application before the Tribunal today.
The landlord did not seek the Tribunal filing fee.
