Crystal Rose Channings owes Kāinga Ora–Homes and Communities $3,406.00 being rent arrears until 10 June 2024 (“the debt”).

Crystal Rose Channings must pay rent and the debt as follows: a. By weekly payments of $197.00, being $187.00 for rent and $10.00 for the debt. b. Payments will be every week, with the first payment on 11 June 2024 and continuing every Tuesday until the debt is paid in full .

Payments will be allocated in the following order: i. rent, ii. rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat 1, 3 Laramie Place, Broomfield, Christchurch 8042 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

The landlord attended the hearing by phone.

The tenant was phoned twice on the number provided but the phone calls went unanswered. The tenant therefore did not attend the hearing despite being properly served with the application and hearing notice. The hearing proceeded in her absence.

As a first preference, the landlord applied for a conditional order pursuant to section 55(1A) and (1B) of the Residential Tenancies Act 1986, that: a. tenant will pay the landlord, every Tuesday a total of $197.00, being current rent of $187.00 plus amount of $10.00 toward rent arrears. b. if the tenant fails to make any payment within 2 days of the due date, then the order will immediately take effect as a final termination order, and i. The total amount of rent arrears will become immediately payable; and ii. The tenancy will terminate; and iii. The landlord will be granted immediate possession of the premises.

I note the landlord provided rent records which prove the amount owing as at 10 June 2024 is $3,406.00

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied, having heard only from the landlord, that the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
