Josh Ross Le Breton owes Kāinga Ora–Homes and Communities $7,183.29 being rent arrears as at 10 June 2024 (“the debt”).

Josh Ross Le Breton must pay rent and the debt as follows: a. By weekly payments of $315.00, being $285.00 for rent and $30.00 for the debt. b. Payments will be every Thursday, with the first payment on 13 June 2024 and continuing until the debt is paid .

Payments will be allocated in the following order: a. rent, b. then rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat 1, 15 Roxburgh Street, Sydenham, Christchurch 8023 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Both parties attended the hearing by telephone.

The landlord has applied for termination and for rent arrears and has provided rent records which prove the amount owing is $7,183.29 as at 10 June 2024.

As a first preference, the landlord applied for a conditional order pursuant to section 55(1A) and (1B) of the Residential Tenancies Act 1986, that: a. tenant will pay the landlord, every Thursday a total of $315.00, being current rent of $285.00 plus amount of $30.00 toward rent arrears. b. if the tenant fails to make any payment within 2 days of the due date, then the order will immediately take effect as a final termination order, and i. The total amount of rent arrears will become immediately payable; and ii. The tenancy will terminate; and iii. The landlord will be granted immediate possession of the premises.

The tenant wants to repay the debt to avoid termination of the tenancy.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant advised that he has obtained employment and will therefore have an income to meet his obligations to the landlord. I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach.

I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
