Reasons

All parties attended the telephone hearing on 24 September 2024.
This was a fixed term tenancy starting from 11 September 2023 with the term intended to end on 11 September 2024.
The landlords discovered in mid-May 2024 that the tenant had moved out. They attempted to contact Ms Weinhold to understand her intentions but did not hear back from her until late June 2024.
I heard evidence during the hearing that satisfies me that the tenant experienced a very stressful and difficult time which resulted in her sudden move to another city. Unfortunately, documents she says she posted to the landlords’ address for service to advise them of her circumstances and seek to terminate the tenancy early, were never received by them and she did not keep a copy. She accepts that she did not try to contact them by any other method.
The landlords were able to re-let the premises from 1 July 2024. They claim rent owing up until this date as being their loss under the fixed term contract and provided rent records in support of the claim. This is $7,000.00.
A tenant can apply to the Tribunal to release them from a fixed term tenancy early if there has been an unforeseen change in their circumstances and the severe hardship they would suffer is greater than any hardship the landlord would suffer if the tenancy were not reduced; see section 66 Residential Tenancies Act 1986 (RTA). The tenant did not apply so I have not considered these grounds.
In the absence of a copy of the documents posted by the tenant, I award the landlords’ claim.
The landlords’ claim is successful, so they are entitled to the filing fee. I refund the bond to them in full.
The parties agreed on a repayment plan for the balance left to pay.
The landlords did not seek suppression of their names and the tenant has not succeeded so her name is published.
