That subsection provides that the tenancy will end on the date that is the 21 st day after the landlord gives the personal representative of the tenant or a person who is the tenants next of kin written notice to vacate the premises.

Written notice was given to the son of the deceased as next of kin, by letter dated 19 March 2024. That notice records that the tenancy is to terminate and that the end date for the tenancy is to be 19 April 2024.

The son remains living at the premises despite efforts by the landlord to relocate the son to appropriate premises.

The tenancy ended on 19 April 2024, which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.
