Kāinga Ora–Homes And Communities is granted possession of the property on Wednesday, 28 August 2024.

Reasons

Kāinga Ora–Homes And Communities has sought possession of the property in order to carry out work necessary to comply with regulations regarding Healthy Homes Standards and any other remedial work found following inspection of the premises. Section 53B(1)(b)(iii) of the RTAct is summarised as follows. The landlord under a periodic tenancy may terminate the tenancy by giving at least 90 days’ notice if following the grant of the tenancy, the social housing provider requires the tenant to transfer to different social housing provided by that provider, and the provider considers that the transfer is necessary or desirable for any reason and the other housing is appropriate for the tenant’s housing needs as most recently assessed (regardless of when that assessment took place).
Isobel had a housing needs assessment in 2019. The landlord has a house available that meets that needs assessment.
The tenant’s preference is to be able to commence another tenancy at 34 North Road, Kawakawa after all work has been carried out at the property. Kāinga Ora–Homes and Communities could not guarantee that will happen however will be in discussions with Isobel’s representative regarding housing for Isobel following her move to 29 Mangakahia Road, Kaikohe.
