Both parties attended the hearing.

The landlord has applied for rent arrears, compensation and refund of the bond following the end of the tenancy.

The tenant had indicated at the case conference held by telephone that she had claims against the landlord. A case conference minute was issued on 21 August 2024 confirming the telephone discussion giving the tenant until 5 pm 11 September 2024 to file her application.

The tenant had not filed an application by 21 August 2024, nor by the date of the hearing. At the hearing the tenant provided a short, written submission but provided no supporting evidence.

The tenant confirmed her email address at the case conference and confirmed that she would accept service by email. The Tribunal’s records show that the tenant was emailed a copy of the case conference minute together with copies of the landlord’s application and supporting documents. She confirmed that she had received the notice of the hearing which was sent to that email address. The Tribunal is satisfied that the tenant was properly served.

In the absence of an application by the tenant by the date stipulated in the case conference minute and because no application was filed by the hearing date, the tenant is not able to file any further application in relation to this tenancy.

The tenancy ended a year and nine months ago. The tenant has had a lengthy opportunity within which to file any claim against the landlord. The landlord is entitled to finality and it is important for both parties that they put the tenancy behind them.

This Order resolves all matters arising out of the tenancy and the Tribunal will not accept any further application by either party in relation to it.

The tenant accepted that she received this sum and did not provide any evidence to dispute the landlord’s rent statement.
