Only the applicant landlord attended the hearing which took place by teleconference today. The tenant was called on the number provided which he has previously been contacted on but the calls went to voicemail four times. The tenant has not filed any further evidence as directed. This application has had three previous hearings.

On The parties entered in to a one-year fixed term tenancy for a studio unit to end on 2 November 2024.

On 26 August 2024 the Tribunal terminated the tenancy by consent and adjourned the proceedings for filing of further evidence by both parties and to hear the remainder of the claims.

The applicant landlord seeks bond refund, rent arrears of $5160.00 to 26 August 2024 and reimbursement of advertising costs in the sum of $297.85.

The tenant disputed the rent arrears and advertising charge on the basis that he has a set off for the following reasons: (a)His quiet enjoyment of the premises was breached due to treatment from a neighbouring tenant. (b)He was required to pay power throughout the tenancy even though the tenancy agreement stated that power would be paid by the landlord. (c)The landlord breached their obligations by failing to repair the rangehood in a timely manner.

On 8 October 2024 the Tribunal heard evidence from the parties in respect of the rent arrears and the advertising fee due to early termination of the fixed term tenancy.

The Tribunal also heard evidence from both parties in respect of the tenant’s set off claims. During the hearing both parties referred to further evidence they wished to file.

The landlord wished to file further evidence including email communication regarding the problem with the neighbour and the invoice in respect of the advertising fee by the landlord.

The tenant wished to file proof of the power costs he paid during the tenancy and further evidence regarding the problem with the neighbour.

The hearing was adjourned for both parties to file the above evidence and any other evidence relevant to the claims and for copies to be sent to the other party.

On 5 December 2024 the hearing was adjourned at the tenant’s request as he was at the hospital with his wife.

Today only the landlord has attended the hearing.

It is noted that no further evidence has been filed since 8 October 2024.

The landlord advised today that they have not been able to obtain a receipt for the advertising costs, therefore, this claim is not proved and is dismissed.

The landlord has applied for rent arrears to the end of the tenancy and has provided rent records which prove the amount owing.

The tenant has not filed any further evidence in support of his set off claim and has not attended today. Therefore, no set off is ordered.
