Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.

The landlord provided the Tribunal with a pre let inspection report and an exit inspection report and photos. The photos show the property had been left dirty and rubbish was throughout the property. The lawns were very overgrown and there was damage to a window, doors, and a ranch slider.

The landlord provided invoices for the cost of the cleaning, repairs, lawns, and rubbish removal. The actual cost to remedy the property after the tenancy was in excess of $10,000.00 according to the invoices and quotes provided to the Tribunal.

I find that the landlord has proven their claim for the cleaning, rubbish removal, lawns, and repairs.

Despite the landlord having proved their actual costs to remedy the tenants breach of the Residential Tenancies Act 1986 and their tenancy agreement, the landlord only seeks the bond in compensation.

I am awarding the bond of $1760.00 to the landlord to offset the debt owed by the tenants to the landlord.

The bond centre is to immediately refund the bond to the landlord.

As the landlord has been successful with their claim, I am reimbursing the filing fee which forms part of the $1760.00 refunded to the landlord from the bond.

The landlord has applied for suppression of their name and identifying details and as they have been successful, I am granting suppression.
