[The applicant/s] and Rafid Zaiden Nsaif attended the hearing held today.
This application concerns a tenancy that started on 18 June 2020 and continued until 5 March 2024.
The landlord has applied for compensation from the bond. The tenant disagrees with some of the claims.
The party that makes a claim has the task for proving their claim. This is called “the burden of proof”.
I record the decisions and agreements below:- a. The tenant agrees to a contribution of $500.00 towards painting over three medium plaster patches on one wall, removal of decorative stickers on one wall and stickers on two bathroom vanities. b. I find that the small corner of torn carpet is more than wear and tear and happened during the tenancy and the tenant has not proven that it was not careless. The damage is minor, and I do not award additional compensation. c. I accept the tenant’s oral evidence that the damage to the internal door was caused by an existing loose piece of door frame that caught on the door and damaged the surface. The tenant is not liable. d. The landlord has not proven any other damage to the inside of the house and has no evidence to show any amount he has paid for repairs. e. The tenant agrees that the carpet in the office was damaged during his tenancy. The landlord has paid $1,300.00 to replace the carpet. I award $1,000.00 (a deduction of $300.00 is fair to recognise that some normal wear and tear is to be expected). f. I award $82.49 to hire a Rug Doctor machine and $90.00 for the landlord’s time to clean the carpet (3 hours labour at $30). It is reasonable the tenant pays to clean the carpet as the tenant kept a dog and this was a long tenancy. g. I award the claim for garden work. Photographs show the lawns were overgrown. Weed-eating, mowing, and tidying were required. A receipt was supplied.
I award the filing fee on this and the previous application (4805041).
The landlord has been substantially successful in the claims so is entitled to suppression of name from any published order.
The bond is split between the parties as ordered.
