No application for suppression has been made in this case and no suppression orders apply to this decision.

The landlord attended the hearing which was held by teleconference. The tenant did not answer either of the calls made to her at the scheduled time on the number provided to the Tribunal.

Because I am satisfied the tenant has been served notice of the hearing in accordance with the Residential Tenancies Act, 1986 and the tenant has not requested an adjournment, the hearing was conducted in the tenant’s absence.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The landlord gave oral evidence and produced photographs that show the tenant has written and drawn extensively across numerous walls in the premises, as well as across the ceiling and fittings in the premises, including the toilet seat.

The landlord served a 14-day notice on the tenant on 16 April 2024 to return the premises to a reasonably clean and tidy condition. The tenant did not remedy the breach within the required period. Several further inspections were conducted and another written notice was issued on 11 July 2024.

Because of the extensiveness of the damage to the property, I consider it would be inequitable to refuse to terminate the tenancy.
