Ms Gray attended the teleconference hearing on behalf of the landlord. [The tenant/s], the tenant, also attended the teleconference hearing.

During the hearing, the tenant said she wanted to give notice that she is moving out of the tenancy property. After some discussion, both parties agreed that the tenant will vacate the property and return the keys to the landlord by 1pm on Friday 27 September 2024.

The landlord has applied for rent arrears and has provided rent records which prove the amount owing to 3 September 2024, which is $5,687.78. Weekly rent is $392.00 so daily rent is $56.00. A further 24 days’ rent @ $56.00/day is payable from 4 September 2024 to 27 September 2024, for a sub-total of $1,344.00. Therefore, the tenant owes the landlord a total of $7,031.78 in rent to 27 September 2024, which is the end of the tenancy.

I note there were discussions during the hearing relating to calculations about what the tenant would owe in rent from the hearing date until the end of the tenancy. After the hearing, I noticed these calculations were incorrect, and so I recalculated the rent owing from the hearing date to the end of the tenancy based on a daily rate for rent. Suppression

Section 95A(4) Residential Tenancies Act 1986 provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

The tenant is 70 years old and has had two adult family members living with her, though she has been the only one paying the rent. The tenant gave notice that she is leaving the tenancy, during the hearing, as she said the rent is too high for her to maintain on her own. She plans to live with another family member after leaving the tenancy. The tenant said she appreciated how patient the landlord was with her, despite past rent payment difficulties. During the hearing, the tenant negotiated a date to leave the tenancy that was agreeable with the landlord, and agreed to make payment arrangements to pay the rent arrears owing after she left, as she said she would be living in a more cost- effective situation then. In the circumstances and given the evidence, I find the tenant’s interests outweigh the public interest in publishing her name. Therefore, I order that the tenant’s name and identifying details are not to be published.
