The landlord attended the hearing by video. The tenant did not attend the hearing.
The landlord claims compensation for replacement of curtains, repairs for a wall hole, light bulb replacement and the filing fee.
The tenancy commenced on 6 April 2019 and ended on 7 July 2024. The tenancy lasted almost five years.
The landlord claimed replacement of all eight curtains in the premises amounting to $1,492.47. At the hearing a quote to replace the curtains was produced. It is not clear why an invoice was not produced. I am therefore unable to determine exactly how much the replacement curtains cost.
The landlord advised that the net curtains were not replaced at the end of the tenancy.
A pre tenancy entry condition report was produced. While not dated it clearly states that it is an entry condition report for this tenancy.
The report records that the drapes in the entry / lounge, bedroom 1, and bedroom 2 had sun damage on the thermal side. In bedroom 3 it states that the drapes have sun damage and some mould. In all rooms the net curtains had small tears and wear and tear due to age.
There are no photographs included in the report to assist in assessing the condition of the curtains at the commencement of the tenancy. At the hearing the landlord said that the curtains were new at the beginning but this information conflicts with the contents of the report.
There are a handful of photographs showing mould on the curtains at the end of the tenancy. It is not clear that the curtains needed to be replaced rather than just cleaned.
Given that the age and condition of the curtains at the beginning of the tenancy is unclear, the wear and tear over an almost five-year tenancy and the presence of mould on at least one set of curtains at the beginning, I decline the compensation for replacement of the curtains.
The landlord claims $253.00 for repairs to a wall hole and replacement of light bulbs. A photograph was produced showing the hole in the wall. The landlord produced an invoice for the repairs.
At the hearing the landlord advised that the tenant had earlier agreed to release the bond to cover some rent arrears. Some of the bond money was applied to the wall repair costs leaving a balance owed of $120.04. That amount is awarded.
