The landlord attended the hearing. The tenant was unable to attend for medical reasons. [The tenant’s representatives], who provide housing support, also attended the hearing, and spoke on the tenant’s behalf (“the tenant’s representatives”).

The landlord applied for termination of the tenancy on the grounds that the tenant had threatened to assault her neighbours. The Tribunal viewed a video of the incident in early July 2024. This showed the tenant threatening the neighbours verbally while standing outside their house. As the argument intensified the tenant smashed a window and had to be taken to hospital. The tenant was charged with assault and wilful damage and pleaded guilty, receiving a community-based sentence.

The Tribunal also understands that the tenant recently served notice to terminate the periodic tenancy and that the tenancy will end on 19 September 2024 in accordance with the notice.

The tenant’s representatives explained that the tenant does not oppose the making of a termination order. However, it will take some time for them to provide accommodation assistance, and there is concern about the tenant’s ability to obtain private accommodation or social housing if the Tribunal’s decision is published.

The landlord and the tenant’s representatives agreed to end the tenancy on expiry of the tenant’s termination notice and both requested suppression for the tenant.

The Tribunal has a discretion to grant suppression having regard to the interests of the parties and to the public interest (section 95A(4) of the Residential Tenancies Act 1986).

The public interest is in favour of open justice and there could be some public concern about the tenant’s behaviour. The tenant’s overriding interest is to obtain alternative accommodation. If I do not grant suppression, the tenant’s representatives may be hindered in the support they can provide. The public interest has already been served to some degree at least by the criminal conviction. I am satisfied that, albeit only marginally, these interests outweigh the residual public interest.
