Reasons

Both parties attended the hearing. The tenant attended in person and the landlord attended via teleconference.
The landlord sought an order that the tenant allow the landlord access to remove the solid fuel burner from the premises that was non-complaint and condemned.
The tenant did not oppose this in principle but wanted the landlord to check the premises for asbestos as well. The tenant’s concern was that the landlord had told her that there may be asbestos in the house and the removal of the solid fuel burner would expose the tenant and her family, including an infant, to asbestos.
It may be wiser for the premises to be checked for asbestos before the solid fuel burner is taken out to ensure there is no danger to the tenant.
However, as this application was for only access for the removal of solid fuel burner, I simply make the order requiring the tenant to allow the landlord access for that purpose with the landlord providing 72 hours’ notice beforehand.
The asbestos issue is mentioned so that the landlord can deal with it appropriately.
The tenant has provided photos of some of the work done at the premises which did not seem particularly well done. There were gaps around the switch board that seemed too big.
The tenant wanted to ensure that the landlord did not make a mess of the premises as her young grandchildren were living there also.
The tenant has been told that she can make an application to the Tribunal if there are issues with the landlord or the work afterwards.
