Sulita Mareko owes Kāinga Ora–Homes And Communities $6,832.46 (“the debt”) as set out below:

Sulita Mareko must pay rent and the debt as follows: a. By 227 weekly payments of $530.00, being $500.00 for rent and $30.00 for the debt. b. A final payment of $522.46, being $500.00 for rent and $22.46 for the debt. c. Payments will be every Friday, with the first payment on 24/01/2025 and continuing until 01/06/2029.

In the event that the rent (currently $500 per week) increases or decreases before the debt is paid in full, Sulita Mareko is to pay rent plus $30.00 per week until the debt is paid in full.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat 13, 5 Gordon Street, Newtown, Wellington 6021 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the phone hearing. Ms Mareko was assisted by her daughter, Rosemary Mareko, who acted as representative.

The landlord has applied for termination of the tenancy, and rent arrears. The tenant wants to repay the debt to avoid immediate termination.

Ms Mareko stated her mother accepts that there are rent arrears owing, but says she is currently challenging the income-related rent charged prior to 7 November 2024. As stated at the hearing, that is a matter between Ms Mareko and the Ministry of Social Development. Given Ms Mareko accepts there are rent arrears owing, I make a conditional order based on the currently available information.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

There was discussion between the landlord and Ms Mareko as to what would be a sustainable amount to make in weekly repayments. Both parties agreed to a top-up payment of $30 per week. Given the parties agreed, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
