Joanna Caroline Simonetti and Watson Manumua owes Kāinga Ora–Homes And Communities $6,332.43 (“the debt”) which is rent arrears to 17 October 2024.

Joanna Caroline Simonetti and Watson Manumua must pay rent and the debt as follows: a. By weekly payments of $315.00, being $295.00 for rent and $20.00 for the debt. b. Payments will be every Wednesday, with the first payment on 23/10/2024 and continuing the debt is paid in full.

Payments will be allocated in the following order: rent and then rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 10 Opua Street, Belmont, Auckland 0622 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986 (RTA).

The tenants said they now realise how serious their situation is and they want to continue living in the house with their daughter. They said they will make paying rent a priority. I am satisfied the tenants will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) RTA.

On 22 April 2024 the Tribunal made an order relating to this tenancy, for rent arrears to that date. The previous order is incorporated into this order for enforcement purposes. Suppression

The landlord made an application for suppression on behalf of the tenants. Suppression is not allowed because there is public interest in social housing and in the tenant’s names when this much money is owed. See section 95A RTA.
