Order
- [The tenant/s] owes Kāinga Ora–Homes And Communities $2,091.00 (“the debt”).
- [The tenant/s] must pay rent and the debt by fortnightly payments of $1,104.00 the first payment commencing on 21 November 2024. These payments comprise the normal fortnightly rent of $1,054.00 and an additional payment of $50.00 toward the debt:
- Payments will be allocated in the following order: rent then rent arrears.
- Those payments are to be made until the debt has been paid in full. When the debt is paid in full, this order will have no further effect.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates the balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for rent arrears. The tenant wants to repay the debt.
- The parties have agreed that a fortnightly payment of $50.00 toward the debt will be achievable, so that is ordered by consent.
- As I explained to the tenant, if the fortnightly payments are missed, then the entire debt will become payable immediately, but providing the fortnightly payments are made, then it is only those amounts that need to be paid.
- The Tribunal has ordered name suppression for the tenant, on the basis that that parties have effectively mediated a resolution of this dispute, and mediations are normally confidential. The landlord has not requested name suppression.
