An application for suppression has been made in this case, and the Tribunal orders suppression of the names and identifying details of both parties.
[The tenant/s] must pay [The landlord/s] $307.00 immediately, calculated as shown in table below.

Reasons

The landlord attended the hearing via teleconference. The tenant did not. Dispensing with the need for service
The tenancy was from 24 th November 2021 until 6 th June 2024.
The landlord’s application was filed on 11 th October 2024. As this application was filed more than two months after the end of the tenancy, the usual service rules no longer apply.
The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986.
Ordinarily, the hearing cannot proceed until effective service has taken place.
If the landlord cannot locate the tenant, despite making all reasonable efforts to do so, the landlord may apply to the Tribunal for a direction that the application is to be served by some other means likely to bring it to the tenant’s notice. Alternatively, the landlord may apply to the Tribunal for a direction that service be dispensed with. See section 91B Residential Tenancies Act 1986.
In this case, there is evidence of the tenant’s using their emails as recently as September 2024 when they received orders from the Tribunal for their own application for refund of the bond.
One of the tenant’s also confirmed with Tenancy Services this morning that they received text notification about today’s hearing but not any notice of hearing.
The Tribunal’s records show that the notices of hearings were sent out to the tenants’ email addresses well in advance of today’s hearing.
Therefore, I am satisfied that the tenants have been notified by email and I dispense with the need for personal service and proceed with the hearing. Carpet cleaning claim
The landlord has applied for compensation for carpet cleaning and reimbursement of the filing fee following the end of the tenancy.
At the end of the tenancy the tenant must leave the premises reasonably clean. This includes the carpet.
The landlord provided photos to prove that the carpet was not left reasonably clean. I find that the carpet stains were more than fair wear and tear and it was not left reasonably clean. The landlord has proven this claim to the required standard.
Having seen the invoice, I order the tenant to pay the landlord $280.00 for carpet cleaning.
Because the landlord has wholly succeeded with the claim, the tenant must also reimburse the filing fee.
