The landlord attended the hearing which was held by teleconference. The Tribunal was unable to contact the tenant on the contact number provided in the application. I was satisfied adequate service of the hearing notice had been completed and considered it reasonable to proceed with the hearing in the tenant’s absence.
The landlord has applied for compensation for rubbish removal and refund of the bond following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord originally applied for $2,452.80 for rubbish removal. At the hearing the landlord advised that the claim had been reduced to $800.00 to better reflect the evidence produced, including the exit property inspection report and photographs.
Based on the evidence provided, the landlord has established that the tenant failed to comply with their obligations under the RTA to remove all rubbish at the end of the tenancy. The tenant’s failure to meet this obligation constitutes a breach of their legal duties, making them liable for the costs incurred by the landlord to restore the property.
The landlord’s evidence is undisputed. The landlord’s claim is reasonable and proportionate to the extent of the breach. The cost sought reflects the actual expenses incurred to return the property to the required standard and is supported by clear and credible evidence.
It is therefore appropriate that the landlord be awarded the costs claimed of $800.00 for rubbish removal.
The landlord waived the filing fee.
