The landlord has applied for termination of the tenancy and rent arrears.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated: s 55(1)(a) Residential Tenancies Act 1986.

I was not provided a complete rent record for this tenancy. Rent records prior to January 2024 were sent to the registry during the hearing. Analysis of past rent breaches would have assisted me in evaluating the likelihood of the Tenant’s breaches continuing in the future.

Based on the Landlord’s evidence of past rent defaults – three occasions in February 2024, and arrears since August, which the Tenant puts down to a mental health crisis – I am not satisfied that it is unlikely the tenant will commit any further breach in future.

The landlord provided rent records which prove the amount owing at the end of the tenancy: $2,790.00.

I am satisfied the Tenant has genuinely experienced hardship, and to publish her name in connection with this decision is likely to create further, undue hardship to her, potentially hampering her ability to find accommodation for herself and her children elsewhere.

IMPORTANT: If Landlord’s seek conditional orders on behalf of their Tenants, they expected to provide a comprehensive rent overview for the tenancy, providing the Tenant’s justifications for non-payment, and showing they have made a considered decision, based on discussions with the tenant when the breaches occur, to continue the tenancy. This does not mean to say that their assessment will be without fault, but some assessment is better than none at all.
