An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
Harvey Frost, Jed Scott-Stafford and Regan Brown must pay [The landlord/s] $6,817.00 immediately, being rent arrears to 12 December 2024.
The tenant’s application to terminate the tenancy under s56D(1) is dismissed.

Reasons

The tenant had applied to terminate the fixed-term tenancy following the withdrawal of a fourth tenant from the tenancy under s56B.
The landlord filed a cross-application seeking rent arrears to today’s date.
I note that, at my direction, in the morning prior to the 2pm hearing, the registry attempted to call all three tenants to inquire whether all three would be attending the phone hearing, or whether one tenant would represent all their interests. The registry advised me contact was only made with Jed Scott- Stafford who confirmed he would attend the hearing.
At the time of the hearing, the landlord attended by phone. I attempted to call all three tenants, however all three calls went to voicemail. Two attempts were made to call the tenant, Harvey Frost, named as the contact person on the tenant’s application. Both calls to Mr Frost went to voicemail. Tenant’s application dismissed
As none of the tenants attended the hearing at the scheduled time, or requested an adjournment, I must dismiss the tenant’s application. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986. Rent arrears
The landlord has applied for rent arrears and has provided rent records which prove the amount owing to today’s date.
I make an order for rent arrears accordingly. Bond
The bond of $3,960.00 is to remain at the Bond Centre. If, at the end of the tenancy, the parties can not agree how the bond is to be refunded, a further application to the Tenancy Tribunal will be necessary.
