An application for suppression has been made in this case, and the Tribunal orders suppression of the names and identifying details of both parties.
[The tenant/s] must pay [The landlord/s] $3,794.72 immediately, calculated as shown in table below.

Reasons

The landlord attended the teleconference hearing on 23 rd January 2025. The tenant did not.
The landlord’s application was filed more than two months after the end of the tenancy so the usual service rules no longer apply.
The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986 (“RTA”).
The application has not been served in accordance with these requirements.
If the landlord cannot locate the tenant, despite making all reasonable efforts to do so, the landlord may apply to the Tribunal for a direction that the application is to be served by some other means likely to bring it to the tenant’s notice. Alternatively, the landlord may apply to the Tribunal for a direction that service be dispensed with. See section 91B RTA.
The landlord explained that the contact details provided in this application form was same as the contact details used in another Tribunal matter where there were no timeframe issues. The hearing for the other matter postdates when this application was made.
Therefore, I am satisfied that the tenant’s contact details provided for this application was reliable. I dispense with the need for any additional service and proceed to deal with the claim.
The landlord has applied for compensation, and reimbursement of the filing fee following the end of the tenancy. The landlord claimed for repair costs for locks, walls and doors and shower as well as the cost for carpet cleaning.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Having seen the photos provided, I am satisfied that the landlord has proven the claims.
Therefore, I order the tenant to pay the landlord as ordered above.
Furthermore, because the landlord has wholly succeeded with the claims, the tenant must also reimburse the filing fee.
