Reasons

The landlord attended the hearing, the tenant did not attend. The tenant did not communicate with the Tribunal about not attending but the advised the landlord that he was ill and would not be attending today.

The earlier Tribunal hearing set down in January 2025 was adjourned because the tenant was unwell. I am proceeding with this hearing as the tenant has not sought an adjournment, nor sough to have a representative appear on his behalf and was he was aware of the hearing today.

This is a landlord application. The landlord seeks to recover unpaid water bills and locksmith fees. In their original application the landlord also sought repairs for drains to be unblocked. The landlord does not seek to pursue the repairs costs and so I am dismissing the landlord’s claims for repairs.

The tenant disputes having to pay the cost of the water bills and says that the landlord has changed their contract about who is responsible for paying the water bills.

The tenancy Agreement signed by the tenant and landlord on 29 June 2019 clearly stated at paragraph 10 that the tenant would be liable to pay the cost of water bills during his tenancy.

The tenant relies on the fact that initially the water supplied to the apartment complex did not have separate water meters installed to allow the landlord to advise the actual cost to each apartment for water.

However, at the AGM of the Body Corporate and Community Managers meeting in April 2021 a motion was passed to install water meters for each apartment.

In April 2022 water meters were installed in the complex.

The tenant has been provided with invoices for water bills from February 2023 through until 28 January 2025, which amount to $1531.08 that have remained unpaid. The Tribunal has been provided with a copy of all the water bills that cover that period.

The tenant is in breach of his Tenancy Agreement by failing to pay the water bills.

I find the landlord has proven their claim for the water bills.

The landlord seeks to claim the cost of locksmith invoices. On 4 November 2024 the landlord changed the locks at the tenant’s apartment at his request as a former associate of the tenant had a key and he could not get it back.

The tenant was provided with an invoice for $402.50 from One Place for Property Ltd to replace the locks and keys on 1 October 2024. Also, an invoice for $157.40 from Armstrong Smarter Security for replacing the mailbox lock on 1 October 2024

The tenant is responsible for the cost of replacing keys to the apartment and mailbox that he requests to be changed or has lost the keys.

I am satisfied that the landlord has proven their claim for the mailbox and apartment locks to be changed.

The landlord has applied for suppression of their name and identifying details and as they have been successful, I will grant suppression.
