Order
- The tenancy of [The tenant/s] at 35B Waterworth Avenue, Onekawa, Napier 4110 is terminated, and possession is granted to Kāinga Ora– Homes And Communities, at 8pm on Wednesday, 11 December 2024.
- The landlord will continue the tenancy if the tenant arranges with MSD, for payments of normal rent plus $100.00; total $580.00 per week, before 11 December 2024.
- [The tenant/s] must pay Kāinga Ora–Homes And Communities $21,979.14 immediately (or by payments if Kāinga Ora–Homes And Communities agrees), being rent and arrears to 11 December 2024.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenancy will continue if the payments arrangement is met.
- Suppression of the tenant’s name is declined. It is not in the public interest for suppression to be granted.
