Reasons

Mr Olds attended the hearing for the landlord. The tenant, Mr Denovan, did not attend.

The landlord applied to terminate the tenancy on the basis that Mr Denovan assaulted, on three separate occasions, two other tenants of the complex (Mr Sheehan and Ms Bryant) and the landlord’s representative, Mr Olds.

Should the tenancy be terminated?

The relevant law is found in section 55(1)(c) of the Residential Tenancies Act 1986 (the Act). That section provides that the Tribunal must make an order terminating the tenancy if the Tribunal is satisfied that the tenant has assaulted the landlord or any neighbour of the premises.

The assault on Mr Sheehan was said to occur on the evening of 11 September 2024. Mr Sheehan provided a signed written statement. He also gave evidence in person. He said that he was outside Ms Bryant’s unit which adjoins Mr Denovan’s unit when Mr Denovan hit him several times, once on the head, with a “cylindrical weapon”. Mr Sheehan suffered injuries from the assault, including a cut to his head which required stitches and bruising to his left arm and shoulder. He realised that he needed help with the bleeding from his head wound and he called an ambulance where he was transported to hospital. The police were also called. Mr Denovan has been charged with injuring with intent to injure as a result of the incident.

I am satisfied, on the evidence before me, that the assault on Mr Sheehan is sufficient to establish the grounds for termination under section 55(1)(c) of the Act. However, for completeness I record that it is more likely than not that Mr Denovan also assaulted Ms Bryant on 24 September 2024 by slapping her across her head, and assaulted Mr Olds on 13 November 2024 by throwing beer over him and throwing the can at him. Mr Olds said that Mr Denovan has been charged with the offence of male assaults female in relation to the assault on Ms Bryant. Tribunal application fee
