The tenancy of Heeni Maaka and Morehu Stafford at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 5:00pm on Sunday 19 January 2025.
Heeni Maaka and Morehu Stafford must pay [The landlord/s] $2,187.00 immediately, calculated as shown in table below.
Rent of $180.00 per week is payable by the tenants until the end of the tenancy with the first payment due no later than Friday 6 December 2024 and every Friday after that with the final payment of $77.15 due on Friday 17 January 2025.
The tenants may terminate the tenancy on any date before Sunday 19 January 2025 by texting or emailing the landlords to notify them of the new termination date.

Reasons

[The applicant/s] (for the landlords), and Heeni Maaka, Morehu Stafford, attended the hearing by telephone on 2 December 2024.
This has been a long tenancy of over ten years.
The landlords seek possession of the property to do extensive renovations and have previously given the tenants written notice ending the tenancy.
Also, the rent is in arrears. The landlord delivered a copy of the rent records to the tenants on 5 October 2024.
The rent record shows that the tenants have been paying an extra $20.00 per week on top of weekly rent of $180.00. However, they sometimes miss payments. This means that they have never fully caught up the rent arrears.
The rent records show the total owing up to 5 December 2024 is $2,580.00.
The landlord told me she has kept the bond of $420.00 that was paid by the tenants at the start of the tenancy.
The bond should have been lodged at the Bond Centre. This is required by section 19 Residential Tenancies Act 1986 (RTA).
I credit the bond money towards the rent arrears. This leaves rent owing of $2,160.00.
The rent was at least 21 days in arrears on the date the application was filed which means that the tenancy must be terminated. See s55(1)(a) RTA.
The landlords and tenants agree to a final termination date of Sunday 19 January 2025. I have made this order.
I also order payment of the rent owing. The tenants could make a repayment plan proposal to the landlords.
The tenants must keep paying weekly rent of $180.00 until the tenancy ends except the final payment which is for only three days rent which is $77.15.
The tenants can choose to continue to pay $200.00 per week (as they have been) and this will reduce the debt that they owe.
The landlord offered to let the tenants move out earlier than the final end date if they send her a text or email to advise her of the final date.
The landlords have been successful with this claim so I must award them the filing fee. They are also entitled to suppression of name, as sought.
