The landlord’s claim for compensation for cleaning and wall damage was adjourned part-heard and concluded on the papers. The landlord was to provide further information by 30 June 2025, being photographic evidence in support of the cleaning and wall damage.
This has now been received, and a final order is issued. Cleaning
As noted in the previous order, at the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986 (the RTA).
The tenant’s obligation is to leave the premises in a reasonably clean and reasonably tidy condition. This is not necessarily pristine, or to the standard a landlord considers acceptable for a new tenant. 1 The standard does not equate to being commercially clean 2 , spotless 3 , or hotel/motel standard of cleanliness. 4
The landlord claims the tenant did not leave the premises reasonably clean and tidy, as shown in the photographs of the condition of the premises at the start of the tenancy, and the end. This evidence establishes that the tenant did not leave the premises reasonably clean and tidy . The landlord had an invoice for window cleaning costs of $200.00 but there was an additional claim of $1,150.00, for cleaning, for which there was no invoice. The landlord states two people completed the cleaning, working for 8 hours. This is a 4 bedroom property with
5 bathrooms.
As part of the cleaning claimed by the landlord is to bring the premises up to a commercially clean standard, for a new tenant, I consider the amount of $850.00 to be reasonable compensation for the cleaning costs incurred by the landlord. This reflects the tenant’s liability for the cleaning, to bring the premises up to a reasonably clean condition. Wall damage
The landlord has now provided the photographic evidence in support of the claimed wall damage. The landlord’s evidence is that the walls and ceiling were newly renovated. After the tenant moved out, there were holes in the walls, as shown in the photographs. The quotation for the wall repairs has been provided. There are three separate areas of damage, some of which appears to be deliberate, while others may be the result of careless damage. Being satisfied that this claim has been established, the amount claimed is awarded above.
