Decided 15 Jul 2025 · Published 15 Jul 2025 · Application 5076848
- Rent arrears
Party names are redacted in the official published order.
Order
- The Tribunal orders suppression of the Tenant’s name and identifying details.
- [The respondent/s] owes Kāinga Ora–Homes And Communities $24,646.86, being rent arrears as at 19 February 2025 (“the debt”).
- [The respondent/s] must pay rent and the debt as follows: a. By fortnightly payments of $974.00, being $874.00 for rent and $100.00 for the debt. b. Payments will be every other Thursday, with the first payment on Thursday 27 February 2025 and continuing fortnightly until the debt is paid in full.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
Reasons
- Both parties attended the hearing which was held by teleconference.
- The landlord has applied for the recovery of rent arrears. The tenant has expressed a willingness to repay the outstanding debt.
- The parties have mutually agreed to the repayment arrangement, ordered above.
- If the tenant fails to make any payment within two working days of the due date, the full outstanding balance will become immediately due and payable. The landlord may then seek to enforce the debt through the District Court.
- The landlord does not seek a suppression order. However, as this is effectively a consent order, it is reasonable and appropriate to suppress the tenant’s name and identifying details.
