At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, and remove all belongings. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).

The landlord provided photos which show lots of belongings and some rubbish left behind at the end of the tenancy. The tenant agreed she left these but said she only had a week to remove everything. This is because she was transferred to another Kainga Ora tenancy at short notice. She moved into the house in 2014.

The representative for the landlord said he did not have the specific information relevant to this transfer at the hearing. He said that sometimes there is short notice if the landlord arranges an internal transfer. However, tenants usually get more than a week’s notice that a move is likely.

The representative asked for an adjournment to allow time to gather more information about the transfer. I was not inclined to allow an adjournment because there is merit in an expeditious resolution of the claim. It also seems most likely to me that the information about the transfer would have been readily available to the representative before the hearing.

I find the tenant had the best evidence about the move. I find she was not given sufficient notice to allow her to remove all her belongings and the rubbish left outside, or to arrange for help. I rely on section 85 RTA which allows me to consider the substantial merits and justice of the case. The landlord’s claim is dismissed. Other orders

I have used my discretion to allow suppression for the tenant because there has been no breach of the RTA. This means her name will not be published. See section 95A RTA.

The landlord no longer takes bonds, so the bond is refunded to the tenant.
