Reasons

The hearing was conducted by telephone. Ms. Rea attended for the landlord. The tenant did not attend.
The tenant was taken into custody on 11 November 2024, and she remains in custody. The landlord has tried to contact the tenant but to no avail. I am satisfied that the tenant is aware of the application and the hearing today and she has had the opportunity to attend. She could have asked to be called at the prison and joined to the hearing and that would have been done. I have therefore proceeded to hear the application in her absence.
The landlord has applied for termination of the tenancy and rent arrears.
On 12 November the landlord served a breach notice on the tenant on the ground that the tenant was not living in the premises and requiring her to resume living there. Plainly, the tenant has not complied with that notice.
Section 56(1) of the Residential Tenancies Act 1986 requires me to consider whether it would be inequitable for the Tribunal not to terminate the tenancy.
The tenancy agreement requires the tenant to live in the premises at all times. That is important because the landlord is a social housing provider and there is a waiting list of people in need of their accommodation. If tenants are not living in the premises, those premises should be available for others needing the accommodation otherwise the housing shortage is exacerbated.
For that reason, it would be inequitable not to terminate the tenancy and so I have made an order terminating it immediately.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
