The landlord attended the hearing today.
The landlord has applied for rent arrears, outgoings, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
I have separately ordered that the bond of $2,000.00 be refunded to the landlord. Rent and Water
The tenancy ended on 16 October 2024. The landlord provided rent records and water invoices which prove the amount owing at the end of the tenancy. Cleaning, Locks, Light Bulbs, Chattels
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy. The exit inspection report shows the carpets were stained in several rooms, the kitchen tops, stove, and cupboards needed cleaning, together with the vinyl flooring and the laundry tub. The cleaning costs for the carpet ($253.00) and general cleaning ($448.50) are within a reasonable range.
The tenant did not return the keys. The locks had to be changed to secure the premises.
The landlord had to replace a heat lamp. Given the price, I am willing to accept that this was a standard bulb.
The heat pump remote was found bent and unserviceable. It had to be replaced.
A doorstop was missing. Damage to the Premises
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or 4 weeks' rent. The insurance excess was $650.00 but applied by insurers to each incident of damage. The weekly rent was $530.00.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
The walls and doors were damaged during the tenancy, as itemised on the invoices. A light shade was broken. The blinds in the kitchen were damaged. The wiring had been pulled out of the internet box, which was replaced. There were several broken window latches. The damage is more than fair wear and tear, and the tenant has not disproved liability.
The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. I award the cost of repairing the damage to the walls and doors in full. There was also a claim for $1,731.66 for painting. The walls had been renovated prior to the start of the tenancy on 22 December 2022. They were about 2 years old. I discount the painting costs by 20% to allow for betterment. I award the filing fee and grant name suppression to the landlord, as requested.
