The landlord attended the hearing which was held by teleconference. The tenant did not attend. The tenant was contacted several times on the contact number provided but on all occasions the call went straight to voicemail. I am satisfied that proper service of the hearing notice has been completed and deemed it reasonable to proceed with the hearing in the tenant’s absence.

On Tribunal made an order on 18 February 2025 which was amended on 20 February 2025 stating:

[The tenant/s] must allow the landlord and its contractors to access the premises for the purpose of testing for contaminants pursuant to section 48(2)(ba) of the Residential Tenancies Act 1986. Access is granted at 10 AM on Wednesday 26 February 2025. This order services as notice to the tenant of the intended entry and the reason for it as per section 48(2)(ba).

If [The tenant/s] fails to comply with this order and does not allow access at the specified time, the tenancy will terminate at midnight on Thursday 27 February 2025 pursuant to section 56 of the Residential Tenancies Act 1986, and possession will be granted to Kāinga Ora–Homes And Communities at that time.

As Ms Ryder did not allow access at the specified time, the landlord took possession on 28 February 2025. Ms Ryder filed an application for rehearing the same day citing grounds that she did not receive notice of the hearing.

Section 105(1) Residential Tenancies Act 1986 provides that the Tribunal has the power to order a rehearing where “a substantial wrong or miscarriage of justice has or may have occurred or is likely to occur”.

Ms Ryder, being the applicant who filed the rehearing application, did not attend the hearing. Without the attendance of the applicant, the rehearing application cannot proceed. Accordingly, the application for rehearing is dismissed, and the original order made stands.
