Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the tenant’s name and identifying details.
- The tenant owes Kāinga Ora–Homes And Communities $3,192.00 for rent to 26 March 2025.
- The tenant] must pay rent and the arrears as follows: a. By 63 weekly payments of $341.00, being $291.00 for rent and $50.00 for the arrears. b. A final payment of $333.00, being $291.00 for rent and $42.00 for arrears. c. Payments will be every Thursday, with the first payment on 27/03/2025 and continuing until 11/06/2026.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied to formalize the arrangement for the payment of rent arrears. The arrangement includes termination of the tenancy if rent or arrears are not paid.
- The conditional termination agreement covered by this order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Suppression
- The Tribunal may, on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published. (s.95A(4). The agreement by the parties regarding arrears is sufficient reason to suppress the tenant’s name and identifying details.
