Gerhard Van Wyk and Soraya Van Wyk must pay [The landlord/s] $2,842.47 immediately, calculated as shown in table below:

Reasons

The landlord attended the hearing held by video conference today. I telephoned the tenants however the phone number did not connect. I continued with the hearing as the tenants have been emailed notice of the hearing date and time to the address for service.
This was a tenancy for a fixed term up to 27 January 2026. A fixed term tenancy agreement acts as a binding contract that the tenants will pay rent until that end date in exchange for the landlord providing the premises for that same term.
The landlord discovered on 12 December 2024 that the tenants had moved out and did not intend to return.
The landlord readvertised the premises for rent and new tenants were found as from 24 January 2025.
The landlord now claims lost rent under the contract and compensation for reasonable expenses related to the early termination of this tenancy.
The tenants have authorised the refund of the bond to the landlord, and this has been credited to the rent account. The rent records were provided.
The remaining rent loss is $1,856.43 and I award this amount as it is a consequence of the breach of the fixed term contract.
The landlord has supplied an itemised invoice for its expenses in arranging for the early termination and consequent replacement tenancy. The detail gives me assurance that the costs are reasonable, and I award these; see s44A Residential Tenancies Act 1986 (RTA).
The landlord seeks an order allowing disposal of goods the tenants left behind. The tenants have not collected the goods and their value is less than it would cost to store, transport or sell them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
The RTA allows a landlord to dispose of goods without a Tribunal order if it first gives a tenant a fair opportunity to collect them, and (if they are not collected) then makes reasonable efforts to assess their market value. If the value is less than what it would cost to store, transport or sell the goods, then the landlord may dispose of them as it sees fit; see s62A RTA.
The landlord has succeeded with the claims so I must award the filing fee and suppress its name, as sought.
