An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord’s names and identifying details.
[The tenant/s] must pay [The landlord/s] $377.00 immediately, calculated as shown in table below:

Reasons

Both parties attended the hearing.
The landlord had applied for rent arrears and a water delivery made on 9 December 2024.
At the start of the hearing today the landlord said that the rent arrears had been repaid and provided an updated rent summary confirming the position.
In respect of the water the landlord said that they contacted the tenant about doing works on the property (which had previously been delayed at the request of the tenant) and that the tenant responded to say that the contractors would need to bring their own water as her water tank had “no water”.
The landlord said that no water was in fact required or used by the contractor but that they arranged for a water tanker to deliver approximately ¼ of a tank of water to the tenant because they were concerned about sanitation and potential damage to the pump and hot water cylinder.
The landlord then sent the invoice to the tenant. A copy was produced at the hearing.
The tenant accepted that she had told the landlord that she had “no water” in her email (a copy of which was produced) but said that she was did so because she was worried that the contractors would use what little water she had left. She said that she had already arranged for an emergency grant from WINZ for the cost of a tanker which she then cancelled. She said that she has no funds to pay for the water that the landlord ordered and that she has now used up her WINZ emergency grant allocation on a further tank of water.
Having considered all of the evidence I consider that the tenant is liable to pay for the water ordered by the landlord. The tenancy agreement provides that water is the responsibility of the tenant. It was reasonable of the landlord to arrange for water to be delivered when the tenant told them that they had no water.
The landlord has been substantially successful and so I have reimbursed the filing fee.
The landlord and tenant have previously been before the Tribunal and an order was made in favour of the tenants. At the conclusion of the hearing the landlord and tenant agreed that the amount ordered today will be offset against the amount owed by the landlord to the tenant. This is a matter for the parties to organise themselves.
The landlord sought an order for name suppression which I have granted as they are the substantially successful party. I have also carried over name suppression for the tenant as they successfully obtained an order for name suppression in the previous hearing but there was not time for this claim to be heard as part of that hearing.
