Ms Wei appeared for the landlord by telephone. Unsuccessful calls were made to each of the tenants on the numbers provided. The hearing has proceeded in their absence.

The tenancy commenced on 18 March 2023 and is periodic. On 10 February 2025, the landlord filed an application seeking termination for rent arrears of more than 21 days, outstanding electricity charges, refund of the bond, and reimbursement of the filing fee.

At the commencement of the hearing Ms Wei informed the Tribunal that, subsequent to filing the application, the tenant gave notice to terminate the tenancy on 04 May 2025. On that basis, the landlord no longer pursued their application for immediate termination, but instead sought rent arrears and rent owing to the end of the tenancy.

The landlord has produced an up to date rent summary. I am satisfied of the rent arrears owing to 29 April 2025, and in the circumstances, I also award the rent due to the end of the tenancy on 04 May 2025. Power usage

There are two properties on the section. The tenant’s is at the front, with another rented property at the rear. The landlord rents out both properties. The main power supply is shared by both dwellings. The tenant’s house has the main meter, the rear property has a separate check meter.

Each month, the landlord receives the electricity account, which remains in the landlord’s name. The landlord messages the tenant in the rear property, requesting them to send photograph of the reading on the check meter. Upon receipt, the landlord deducts the rear properties usage from the account and sends that tenant a separate invoice. The landlord then sends the front tenant the actual account, including details of the calculation.

The landlord has produced the five invoices for the period 22 November 2024 to 23 March 2025. Each invoice contains details of the above calculation. The landlord has also produced a schedule showing that the total amount owing for that period remains unpaid.

Section 39(3) of the Residential Tenancies Act 1986 (the “Act”) states that tenants are responsible “for all outgoings that in respect of the premises exclusively attributable to the tenant’s occupation of the premises”.

Based on the evidence, I am satisfied that the tenant is liable for the power usage claimed, and the amount claimed is awarded. Costs

Because AI Homes Real Estate Limited as Agent for Xubin Fang and [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee. Name suppression.

Although entitled to name suppression, the landlord does not seek it, and no orders are made.
