I deal with the landlord’s application first. The landlord’s claims

The landlord sought for 1 day’s rent arrears of $124.29.

After having had the opportunity to fully review the entire rent summary, the tenant accepted that there was 1 day’s rent in arrears.

Therefore, I order the tenant to pay the landlord $124.29 from the bond for rent arrears.

The landlord also claimed $368.00 for damage to 2 tiles in the bathroom.

The tenant denied causing any damage to the tiles.

For damage claims, a landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

The landlord did not have close-up high-quality photos of the same tiles from the beginning of the tenancy to prove that the chips on the tiles were not pre- existing.

Further to that, there was a term of more than 10 days between the tenant vacating the premises and the chips on the tiles being brought to the tenant’s attention.

I am not satisfied that the tenant has carelessly or intentionally caused or permitted the damage to the tiles.

This claim is dismissed. The tenant’s claims

[The tenant/s]claimed that the landlord discriminated against them.

A landlord must not discriminate against a tenant in relation to the grant, renewal, variation or termination of a tenancy, in contravention of the Human Rights Act 1999.

Section 21 of the Human Rights Act specifies the prohibited grounds of discrimination, which include sex, marital status, religious or ethical belief, race or ethnicity, disability, age, political opinion, employment status, family status, and sexual orientation.

Breaching this obligation is an unlawful act for which the Tribunal may award exemplary damages up to a maximum of $6,500.00. See section 12(1) and Schedule 1A Residential Tenancies Act 1986. 5164511, 51653913

The tenant claimed that their fixed-term tenancy ended without any discussion of extending the tenancy. The tenant said that the previous property management company had made them think that the tenancy could be extended.

However, the landlord explained that the owners moved back into the premises after this fixed-term tenancy ended. Notice to not renew the fixed-term tenancy was given by the landlord within the applicable time period.

The tenant also said that the landlord spoke down in a way to the tenants. However, I do not accept that after having read the email correspondences.

The tenant could not prove that there was any act of discrimination or that the termination notice was given in retaliation of the tenant exercising their rights.

The tenant’s claims are dismissed. Filing fee and refund of the bond

As neither party had wholly or substantially succeeded with their respective applications, I make no order for reimbursement of the filing fee.

The bond will be refunded to the tenant with only the rent arrears being deducted.
