Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 22 February 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

The brief history of the tenancy is that the tenancy was a fixed term tenancy commencing on 14 January 2025 and ending on 20 January 2026.

On 25 January 2025, the landlord received a telephone call from one of the tenants explaining that three of the tenants had to leave New Zealand and that they wanted to end the fixed term tenancy. Discussions took place between the tenants and landlord over the next few weeks without the issue being resolved.

On 20 February 2025, the landlord sent a notice to the tenants informing them of his intention to carry out an inspection of the premises on 22 February 2025. The landlord said that upon entering the premises on 22 February 2025, it was apparent that the tenants had left. No tenant belongings, furniture, mail or food was found. The landlord provided photos of the premises.

The tenants attending the hearing said that three of the other tenants had left New Zealand leaving them responsible for the rent. They said that they were not happy with the condition of the premises and referred to mould being present. No supporting evidence of that proposition was provided to the Tribunal. The landlord did provide an updated Healthy Homes Standards report which indicated that the premises were compliant. No breach notice was issued by the tenants to the landlord. In those circumstances the tenants are not simply able to leave the tenancy and escape their contractual responsibilities.

As the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

Both parties applied for name suppression. The landlord has been wholly successful in this matter and suppression of the landlord’s name and details is ordered. The tenants have not been wholly or substantially successful in this hearing and the application for suppression is dismissed.
