Julia Therese Connell must, by Friday 28 March 2025, make the premises reasonably clean and tidy. If she has not done so to the landlord’s satisfaction, the tenancy at [the premises] will terminate, and the landlord will have immediate possession of the premises.

The hearing was conducted by telephone. Ms Thompson attended for the landlord. The tenant did not attend. Calls to her at the time of the hearing went straight to voicemail.

The landlord has applied for termination of the tenancy on the ground that the tenant has not kept the premises reasonably clean and tidy.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate it. Where the breach is capable of remedy, the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. See section 56(1) of the Residential Tenancies Act 1986.

The tenant has breached her obligations by failing to keep the premises reasonably clean and tidy. The landlord produced photographs showing the unit filled with an extreme amount of inorganic and organic material. The condition of the premises creates a significant health and safety risk for the tenant and for others.

The landlord has served three breach notices on the tenant for the same breach. They have worked with the tenant and with other agencies to try to rectify the situation to no avail. The tenant seems to be unable or unwilling to act herself or cooperate with others to deal with the situation.

The most recent breach notice was served by the landlord on the tenant on 29 November 2024. Because the breach was not remedied within the required period the Tribunal may terminate the tenancy.

Due to the seriousness and risks of the situation for all parties concerned, it would be inequitable to refuse to terminate the tenancy.

The landlord seeks a conditional termination order to give the tenant a final opportunity to avoid termination. I have therefore made an order requiring the tenant to remedy the breach within 14 days otherwise the tenancy will be terminated.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I accept that the tenant’s name and identifying details should be suppressed due to her mental and physical impairments. The public interest in publication does not outweigh the prejudice to the tenant of publication.
