[The tenant/s] must pay rent and the debt as follows: a. By weekly payments of $200.00, being $159.00 for rent and $41.00 for the debt. b. Payments will be every Wednesday, with the next payment on 16/04/2025 and continuing until 11/02/2026.

Payments will be allocated in the following order: rent and rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986 (the “Act”).

The tenancy commenced 3 June 2020 and is periodic. The parties entered into a mediated agreement for rent arrears on 29 January 2025, whereby the tenant paid the landlord $159 rent and $41 for rent arrears weekly. On 27 March 2025 the landlord filed an application for termination of the tenancy for rent arrears for more than 21 days. The application was made on the basis the tenant failed to make a payment on 8 March 2025. The landlord states since the beginning of the tenancy at least three breach notices have been served and that there had been other arrangements entered into. An updated rent summary has been provided which shows that despite missing the rent payment concerned, the tenant has in fact made all payments in the period to date. The tenant states the missed payment was due to a stand down period and that they were unaware the payment had been missed. Upon discovery the tenant has made up the missed payment. The tenant states that their rent is being paid by MSD and is satisfied that moving forward there should be no further issues. The landlord no longer seeks immediate termination and feels a conditional termination order is appropriate. In the circumstances I agree. I am adopting the payment agreement, already agreed, and formalising it in the conditional order.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) of the Act. Name Suppression

Both parties seek name suppression and section 95A of the Act provides that a party that has been wholly or substantially successful in proceedings may have name suppression. In this case I consider that both parties have been sufficiently successful, and both are entitled to name suppression.
