Reasons

The landlord attended the hearing. The personal representative of the tenant did not attend the hearing.

The landlord had applied for termination pursuant to section 56 on the basis that a 14-day notice was served on the tenant. The notice was dated 18 February 2025 and referred to the clause 1 in the tenancy agreement that requires the tenant to live at the premises at all times.

The neighbours advised the landlord that the tenant had not been seen since the beginning of the year. 1 Clause 24

The tenant was the sole tenant of this tenancy.

On 5 May 2025 the landlord received confirmation that the tenant had passed away at Auckland Hospital on 31 January 2025. On the same day the landlord posted a notice giving the executors of the tenant’s estate notice to end the tenancy pursuant to section 50A(1)(b) of the Residential Tenancies Act 1986.

Since giving notice, the landlord has not been contacted by any family member, next of kin or personal representative for the tenant. The notice expired on 26 May 2025.

The tenant had identified a contact person when the tenancy commenced in 2013 but when the landlord made contact that person advised that they had not heard from the tenant for 10 years.

While the landlord has posted notice to end the tenancy on the door of the premises it is unlikely that notice has come to the attention of any personal representative for the tenant if they exist. However, I am satisfied that the landlord has done all that they can do to notify the tenant’s personal representative.

Even if the notice is not sufficient section 50A(2) of the Residential Tenancies Act provides that, “If a landlord is unable to give notice to vacate under subsection (1)(b), the landlord may apply, without notice, to the Tribunal for an order to terminate the tenancy.”

I am satisfied from the evidence submitted that the sole tenant has passed away and an order terminating the tenancy is appropriate. The application to terminate the tenancy is granted pursuant to section 50A of the Residential Tenancies Act 1986.

The name of the tenant is suppressed from this order pursuant to section 95A(4) as I consider that under the circumstances there is no public interest in identifying the tenant.
