An order for breach of the Healthy Homes Standards, due to: i. Dampness, mould, and poor insulation. ii. Broken gutters and a dangerously deteriorated deck. iii. Holes in flooring and water-damaged walls due to leaking pipes. iv. Lack of heating and moisture control. c. An order for exemplary damages for unlawful acts by the landlord, including: i. Failing to lodge a bond. ii. Renting out a property that was not up to healthy living standards. iii. Ignoring repair responsibilities despite the known disrepair. d. Recognition of financial distress, including: i. Borrowing $3,450 to secure a new rental. ii. Inability to repay remaining rent owed (approx. $800–900). e. Acknowledgment of the impact on his and his children’s health and well- being, including frequent respiratory illnesses caused by the poor living conditions. Settlement discussion
