Order

Suppression orders are to apply to the tenant’s name and identifying details.
[The tenant/s] is to ensure that the property is reasonably clean and tidy by Friday 27 June 2025.
If [the tenant/s] fails to comply with Order 2, the landlord is to engage with [the tenant/s] and his children at the first instance, and if the breach continues: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises.

Reasons

Both parties attended the hearing. Ms Rea represented the landlord. [The tenant/s] attended with his daughter.
It is agreed that the tenant has breached section 40(1)(c) of the Residential Tenancies Act 1986 (the RTA) as he has failed to keep the premise reasonably clean and tidy.
His children are now involved due to his health conditions, and they say they have cleaned the property and will assist him to continue to keep it so.
Accordingly, a conditional termination order as sought by the landlord is consented to.
It is agreed that if the landlord does not consider the condition met, they will engage with the tenant and his children prior to taking any steps to end the tenancy. This is a sensitive situation for all.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) RTA.
Because this is a consent order and due to the tenant’s health conditions, it is just that his identifying details be suppressed, see section 95A RTA.
