Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant’s name and identifying details.
- The tenant must carry out the following work to the premises, which must be completed by 12 September 2025: (a) Remove all car tyres from the premises; and (b) Remove the car shell from the premises; and (c) Remove all rubbish from the grounds of the premises.
- As an alternative to compliance with Order 2, the tenant must pay the landlord $1,079.09 immediately.
- If the tenant fails to comply with either Order 2 or 3 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $1,079.09. These costs may be treated as rent in arrears and enforced accordingly.
Reasons
- Both parties attended the hearing which was held by teleconference.
- This Order should be read together with the Tribunal Order dated 17 June 2025. In that Order I detailed the issues that the tenant was required to remedy – for example the removal of a lot of rubbish, the removal of car tyres – pursuant to s40(1)(c) of the Residential Tenancies Act 1986 (RTA).
- The tenant did not attend that hearing and I adjourned it so that the landlord had the opportunity to provide the Tribunal with the costs of remedying the issues so that I could make work orders and a corresponding monetary order as an alternative.
- At today’s hearing it was established that the tenant had done a significant amount of work to remedy the issues described in the first Order.
- There is still a way to go and at today’s hearing we saw that there are still 11 car tyres on the premises, a car shell and about 5-6m 3 of rubbish.
- The landlord provided a quote for work required to remedy all of the issues described in the original order and at today’s hearing we worked through that quote to establish how much it would cost to remedy the remaining issues.
- Specifically, it would cost $162.69 to remove the car tyres, $115.00 to remove the car shell, and $938.34 to remove the remaining rubbish. These costs are exclusive of GST.
- On these figures I have concluded that an alternative monetary order would be a total of $1,079.09, which is also the limit of the charges for the landlord to do the work if required.
- Further to this, I am using my discretion pursuant to s95A(1) RTA to suppress the tenant’s name. I do so because I see no public interest in having it published. I also note that the landlord supports this suppression. C ter Haar 12 August 2025
