Both parties attended the hearing. The landlord was represented by [the landlord’s representative], who attended the hearing by video. The tenant attended by telephone.

The landlord has applied for termination of the tenancy and rent arrears. Jurisdiction

The issue of whether the Tribunal had jurisdiction needed to be considered.

The parties agreed that the agreement between the landlord and tenant was verbal, and the intention was for the tenant to reside at the premises in his house bus while using the facilities (shower, toilet and kitchen) contained in one of the buildings on the premises. The tenant was to pay $250.00 per week.

The tenant has remained at the premises for almost four years and had with the agreement of the landlord moved into the premises while renovating his house bus.

On the evidence I am satisfied that this is a residential premises as defined by section 2 of the Residential Tenancies Act 1986: “...any premises used or intended for occupation by any person as a place of residence, whether or not the occupation or intended occupation for residential purposes is or would be unlawful.”

While section 5 of the Act provides cases where the Act is excluded none of these exclusions apply to this case.

The tenant had submitted that his company now leases the premises, but the company did not exist when the tenancy commenced and there is no record of any lease between the landlord and the tenant’s company. Also, the tenant continues to use the premises for residential purposes.

It is therefore declared that this situation is a residential tenancy and within the jurisdiction of the Tenancy Tribunal. Landlord application

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing up until 19 April 2025. The landlord did not provide an updated rent summary for the hearing and confirmed that no rent was sought other than the $5,100.00 that was owed on 19 April 2025. That amount is awarded.

The tenancy is terminated on 1 June 2025. The landlord confirmed that the tenant could have until the end of June 2025 to remove all his belongings from the premises.

As the landlord has been successful with his application, I suppress the both the name of the landlord and his representative.
