Both parties attended the hearing.

The tenant has applied for reduction of the fixed-term tenancy due to end on 8 July 2025 and bond refund.

The landlord has applied for rent outstanding and water rates and has provided rent and water records which prove the amounts claimed.

The tenant consents to the payment of the water charges from the bond.

The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986.

There has been an unforeseen change in the tenant's circumstances. The tenant entered into this tenancy jointly with her sister. Due to an unforeseen tragic event towards the end of 2024 the tenant’s sister has had a health relapse and returned to live overseas.

The tenant would suffer severe hardship if the term of the tenancy were not reduced as she is unable to continue paying the rent without assistance from her sister.

The landlord would suffer hardship if the term is reduced due to the cost of reletting the premises earlier than expected.

I find that the tenant’s hardship would be greater than the landlord’s hardship.

Where the Tribunal reduces a fixed-term tenancy, it may order the tenant to pay the landlord reasonable compensation for any resulting loss. See section 66(2) Residential Tenancies Act 1986.

The tenant left the premises on 24 April 2025.

The landlord seeks payment of lost rent to 7 May 2025 being the date before new tenants moved into the premises.

The tenant notified the landlord on 10 April 2025 that she could no longer continue with the tenancy and moved out on 24 April 2025. The tenant paid the landlord $850.00 for the costs associated with advertising and reletting the premises on 14 April 2025 and the landlord advertised immediately.

I order the tenant to pay compensation by way of rent to 7 May 2025 in the sum of $1554.29.

Because both parties have succeeded with their claims, I must reimburse the filing fee and suppress their details as applied for. See sections 102(4) and 95A(1) Residential Tenancies Act 1986.
